Terms of service for venues
Last updated [date]
The agreement
These terms are between [Company legal name] ("we") and the business that creates a Tap Loyalty account ("you"). By creating an account you accept them.
The service
Tap Loyalty provides digital stamp cards: a staff app, a customer page, Wallet passes and an admin panel. You need an Android phone with NFC at your counter. We aim for the service to be available at all times, but we don't guarantee it will be uninterrupted.
Trial, price and payment
- New venues get a free trial of [14] days. No card is needed to start.
- After the trial, the subscription costs the price shown on our website when you subscribe, billed monthly in advance. Founding venues keep their founding price for the first 12 months.
- Prices exclude VAT, GST or sales tax, which are added where they apply.
- If a payment fails, we tell you by email. If it isn't fixed within [14] days, stamping may be paused until it is. Your customers' stamps are kept.
Cancelling
You can cancel any time from the billing page. The subscription runs to the end of the paid month and isn't refunded for part months. You can export your customer list before you leave. We delete your customers' details 30 days after cancellation, or 90 days after your free trial ends if you don't choose a plan.
Your responsibilities
- Honour the rewards your customers earn under the rules you set.
- Only press Stamp for real purchases, and keep staff devices secure.
- Only send offers to customers who agreed to receive them, and follow the law where you trade.
- Keep your account login private.
Customer data
You are the controller of your customers' details; we process them on your behalf under our data processing agreement, which forms part of these terms. Cards with no activity for 24 months are deleted.
Liability
Nothing in these terms limits liability that can't be limited by law. Otherwise our total liability in any 12 months is limited to the fees you paid us in that period, and we aren't liable for lost profits or indirect losses.
Changes and ending the service
We'll give at least 30 days' notice by email of changes that affect you materially. We may suspend accounts that break these terms or are used for fraud.
Law
These terms are governed by the laws of [England and Wales], and the courts there have jurisdiction, unless the law where you are based says otherwise.
